1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the digital marketing services provided by GrowthStar Digital ("GrowthStar," "we," "our," or "us"), including our management of Facebook Pages, Instagram accounts, and Lead Ad campaigns on behalf of business clients.

By engaging GrowthStar Digital's services as a business client, or by submitting your contact information through a Lead Ad form managed by GrowthStar Digital, you agree to be bound by these Terms.

2. About Our Services

GrowthStar Digital provides digital marketing services including but not limited to:

• Management of Facebook Pages and Instagram business accounts
• Creation, execution, and optimization of Facebook and Instagram advertising campaigns
• Lead Ad campaign management and lead capture
• Lead routing and CRM integration via the Apex Revenue OS platform
• Content creation and social media strategy
• Campaign performance reporting and analytics

Our services are provided to businesses ("Clients") in the hospitality, healthcare, golf, and related industries.

3. Lead Ad Submissions

3.1 Consent to Contact

When you submit your contact information through a Lead Ad form managed by GrowthStar Digital, you expressly consent to being contacted by the business whose ad you responded to.

• Phone call or text message
• Email communication
• Direct mail where applicable

3.2 Accuracy of Information

You represent that all information submitted is accurate, current, and belongs to you.

3.3 No Purchase Obligation

Submitting a Lead Ad form does not obligate you to purchase any product or service.

4. Client Responsibilities

• Provide accurate business information and assets
• Comply with all advertising laws and Meta policies
• Protect lead data and privacy
• Respond professionally to leads

5. Intellectual Property

5.1 Client Content

Clients retain ownership of their content and brand assets.

5.2 GrowthStar Digital Content

Marketing strategies, copy, and creative assets developed by GrowthStar Digital remain our intellectual property unless otherwise agreed.

7. Data and Privacy

Lead data collection and processing are governed by our Privacy Policy.

8. Disclaimers and Limitations

8.1 No Guarantee of Results

We do not guarantee specific lead volume, sales, or advertising results.

8.2 Platform Availability

We are not responsible for outages or platform changes made by Meta.

8.3 Limitation of Liability

Liability is limited to fees paid within the three months preceding a claim.

8.4 No Warranty

Services are provided on an "as is" and "as available" basis.

9. Indemnification

Clients agree to indemnify and hold harmless GrowthStar Digital from claims related to their business operations, advertisements, and use of lead data.

10. Termination

• Campaign management ceases upon termination
• Outstanding fees remain due
• Applicable provisions survive termination

11. Governing Law

These Terms are governed by the laws of the State of New Jersey, USA.

12. Changes to These Terms

We may update these Terms from time to time with notice to active clients.

13. Entire Agreement

These Terms, together with our Privacy Policy and service agreements, constitute the entire agreement.
